PROTECTION & WATER RESOURCES

Overview

Protection & Water Resources diversion was established under the kedah Water Resources Board which has been approved by the Enactment. The unit is divided into two parts, namely the protection and use of water resources. Overall, the unit responsible for managing the water resources of the earth such as abstraction and alternative water sources, reviewing and regulating the issuance of licenses, identification of pollution sources and provide recovery plan. In addition, the unit also conduct awareness programs to protect and preserve water resources. The number of members involved in this unit is four. That consists of Engineers J41 (Puan Siti Hawa binti Alias Dalila) two Assistant Engineer (Puan Siti Binti Syazwani Sobbihi), (Ms. Farah Bint Mohammad Uswati Rohmatullah) and an Assistant Environmental Control Officer (En Mohd 'Atif bin Saad) Overall, the unit will be responsible for managing the water resources of the earth such as abstraction and alternative water sources, reviewing and regulating the issuance of licenses, identification of pollution sources and provide recovery plan. In addition, the unit also conduct awareness programs to protect and preserve water resources.

Functions of the Diversion

Ensuring the provision of the Board and the regulations promulgated thereunder and enforced in accordance with the development plan of the Board.

To coordinate, supervise and provide guidelines on the abstraction of ground water resources and alternative sources of water.

Implement community awareness programs, departments, non-governmental organizations (NGOs) and other relevant agencies.

Review of the production license and regulate any abstraction of groundwater resources and alternative sources of water, extraction of sand, and release of the sludge at the rate prescribed charges.

Provide input in the implementation of the Development Planning to ensure the planning, development and land use zoning related to water resources, river basin (IRBM) and coastal waters (ICM) is set and adjusted by the kedah water resources enacment 2008.

To monitor and identify the source of contamination and to provide plans for the restoration and maintenance of pollution control.

Prepare Strategy Plan to address issues related to the protection and conservation of water resources.

Water Abstraction

LSANK is implementing a licensing scheme and a charge of water resources in the State in accordance with the provisions of the Enactment of Water Resources 2008.

This is to ensure ground and surface water intake in the country must be under control in terms of quality and quantity in accordance with the LSANK, which is coordinating the exploration and development of additional water resources.

Source Water includes any River, River Basins, Ground Water or Water Bodies.

Offenses and Penalties

Subject to Section 24, Water Resources Enactment Kedah 2008 requires that all activities water abstraction must have or obtain a license unless the activities are subjected in Section 25 (a), Section 25 (b) and Section 27 (1) (a) and Section 27 (1 ) (b). According to this Act as well (section 77) penalties will be imposed against those who committed the offense, punishable by a fine not exceeding RM 300,000.00 (Ringgit Malaysia Three Hundred Thousand) or imprisonment not exceeding three years. If the offense is carried out continuously, the fault will be further fine not exceeding RM 10,000.00 (Ringgit Malaysia Ten Thousand) per day for each day the offense continues under section 89.
